Gazebo Height Planning

I am planning a gazebo which will be positioned against my boundary fence, the overall height of the pitched roof is 3.0m.

The guidelines say I can only have a structure that is 2.5m tall, if I lower the ground level by half a meter so from the original ground level it will only be 2.5m tall is that acceptable?

I have looked but cannot find anything on this.

In the U.S., that’s a Planning Commission decision not a Building Code issue. I’d go in (or call them) and explain the situation.

Here, some jurisdictions will allow you to do what you suggest and some will even allow you to pile dirt against a structure to keep it below the maximum height allowed. Other jurisdictions take the average height of the existing building site.
