We have a leaking shower. We have replaced the seat and stem on the water but it still leaks. Also the diverter does not shut off all the water.

You need to replace the diverter, which in your case is also part of the spout. This should be a relatively easy and cheap replacement. Usually the spout is held on with a set screw located in the bottom - you loosen the screen and the spout will twist/pull off. Replace it with a new spout and diverter, tighten the screw and enjoy!
So it looks like it was a bad part, see the o-ring missing below. BTW, you just need a deep socket wrench to remove the diverter, I wasted a few hours looking for plumber's wrenches before figuring this out...lol.
Glad it's working now but this valve kit was brand new, seems odd that something so critical would be missing. Also the part that I pulled seems used or refurbished (see discoloration). I hope the rest of the valve is ok.

To oversimplify things, a shower control has two parts: the fixed part attached to the pipes in the wall, and everything else (which is usually the cartridge and possibly some O-rings if they are separate).
If you've replaced "everything else", then the problem is the fixed part in the wall.
